Federal Court Finds California Magazine Ban Violates the Second Amendment

In the case of  Duncan v. Becerra,  Judge Roger T. Benitez of the U.S. District Court for the Southern District of California found California’s ban on commonly possessed firearm magazines violates the Second Amendment. 


This case was before the U.S. Court of Appeals for the Ninth Circuit in July of 2018. A panel of 3 judges upheld Judge Benitez's suspension of the suspension of enforcement. The case was sent back to Benitez for further preceedings on the merit of the law.   

Judge Benitez ruled, the law would fail and

characterized it as

“turning the Constitution upside down.”


Now the question is what effect will this have on the rest of the country and more specifically in state's with magazine restrictions.
